1. Acceptance of Terms

By accessing or using the Build Visory website at buildvisory.org, submitting a consultation request, or purchasing any service from Build Visory, you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our website or services.

Build Visory reserves the right to modify these Terms at any time. Continued use of the website or services after changes are posted constitutes your acceptance of the updated Terms.

2. Nature of Services

Build Visory is a Development and Code Compliance Consulting firm. We provide advisory and administrative support related to zoning research, regulatory compliance, building permit consulting, and project development coordination in Louisville, Kentucky and surrounding areas.

Build Visory does not provide legal advice or legal representation. Nothing on this website or in any consultation constitutes legal advice. For legal interpretation of codes, regulations, or zoning ordinances, or for legal representation in any matter, you must consult a Kentucky-licensed attorney.

Build Visory is not a licensed contractor, licensed architect, licensed engineer, or licensed surveyor. Where such services are required for your project, Build Visory coordinates with appropriately licensed professionals on your behalf or at your direction.

3. Service Tiers & Pricing

Build Visory offers the following advisory service tiers:

• Virtual Advisory Services — remote consultation via video or phone, starting at $200 per hour
• On-Site Visit Advisory — in-person advisory at your property or project site, starting at $400 per hour
• On-Site Elevation & Pre-Conceptual Sketch Creation — field measurements and pre-conceptual sketches, starting at $400 per hour
• Architectural & Structural Design Services — individually scoped, custom quotation

All prices are in US Dollars. Rates are subject to change. The rate applicable to your engagement is the rate confirmed at the time of booking.

4. Payment Terms

Payment for hourly advisory services is collected at the time of booking through our secure online checkout, powered by QuickBooks Payments (Intuit Inc.). Your consultation slot is confirmed only upon successful payment.

For Architectural & Structural Design Services, a retainer or advance payment may be required before work commences. The specific amount and schedule will be confirmed in writing before the engagement begins.

All fees are non-refundable once a consultation has been conducted or design work has commenced, except where required by applicable law or as otherwise agreed in writing by Build Visory.

5. Cancellation & Rescheduling

If you need to cancel or reschedule a consultation, please notify us at least 48 hours in advance by emailing naya@buildvisory.org. Cancellations made with less than 48 hours’ notice may not be eligible for a credit or rescheduling. Build Visory will make reasonable efforts to accommodate reschedule requests subject to availability.

6. Scope of Advisory Services

All Build Visory advisory services are provided in a professional advisory capacity. Our consultations are based on the information provided by the client and our review of publicly available regulatory materials. Build Visory advisory output:

• Is informational in nature and does not constitute a permit application, regulatory determination, or legal opinion
• Does not guarantee approval of any permit, variance, rezoning, or regulatory submission
• Does not substitute for review by the applicable permitting authority, code enforcement office, or licensed professional
• Is based on regulations in effect at the time of the consultation — regulations change and clients should verify current requirements independently

7. Client Responsibilities

You agree to provide accurate, complete, and timely information about your project, property, and regulatory situation. Build Visory’s advisory output is only as reliable as the information you provide. You are solely responsible for:

• The accuracy of information submitted to Build Visory
• Decisions made based on Build Visory advisory output
• Filing, submitting, or acting on any permits, applications, or regulatory documents
• Engaging licensed professionals where required by law or by the applicable jurisdiction
• Compliance with all applicable federal, state, and local laws and regulations

8. Intellectual Property

All content on the Build Visory website — including text, graphics, logos, and page layouts — is the property of Build Visory and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any website content without prior written consent from Build Visory.

Any documents, sketches, reports, or materials prepared by Build Visory for your project remain the intellectual property of Build Visory until full payment is received, after which ownership transfers to you as described in your engagement agreement.

9. Disclaimer of Warranties

THE WEBSITE AND ALL SERVICES PROVIDED BY BUILD VISORY ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Build Visory does not warrant that its advisory output will result in permit approval, regulatory clearance, or any other specific outcome. Regulatory determinations are made exclusively by the applicable government authority.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUILD VISORY AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, PERMIT DENIALS, PROJECT DELAYS, OR REGULATORY ENFORCEMENT ACTIONS.

IN NO EVENT SHALL BUILD VISORY’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES EXCEED THE TOTAL AMOUNT YOU PAID TO BUILD VISORY IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Build Visory and its officers, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) inaccurate or incomplete information you provided to Build Visory.

12. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Kentucky, without regard to its conflict of law provisions. Any dispute arising out of or related to these Terms or our services shall be resolved exclusively in the state or federal courts located in Jefferson County, Kentucky. You consent to personal jurisdiction in those courts.
